Terms of Service

These terms are an agreement between you and Swimming in Sales LLC, a Florida limited liability company ("we", "us"), covering your use of PoolCast AI at poolcast.ai and app.poolcast.ai. By creating an account or using the service, you agree to them.
What PoolCast AI is
PoolCast AI takes a photograph you upload and generates an illustrative image showing how a pool might look in that space, based on the build options you select.
Renders are concept images for visualization only. They are not designs, quotes, surveys, or engineering plans. They do not reflect setbacks, easements, utilities, soil conditions, drainage, permitting requirements, or local code. Any actual pool is subject to site conditions and approval by qualified professionals. Do not present a render as a construction document or as a guarantee of what will be built.
Your account
You need an account to generate renders. You are responsible for keeping your login credentials secure and for everything done under your account. You must be at least 18 years old. One account is for one person — do not share credentials.
Free renders
New accounts include a limited number of free renders. No payment details are required to use them. Once the free allowance is used, a paid subscription is required to continue generating renders. We may change or end the free allowance for new accounts at any time.
Subscription and billing
- The subscription is $29.99 per month and includes 100 renders per month.
- Payment is processed by Stripe. By subscribing, you authorize us to charge your payment method on a recurring monthly basis.
- The subscription renews automatically each month until you cancel.
- Unused renders do not carry over to the following month.
- You may cancel at any time. Cancellation stops future charges and your access continues to the end of the period you have already paid for.
- We may change pricing with at least 30 days' notice by email. Continuing to use the service after the change takes effect means you accept the new price.
Refunds
All payments are final and non-refundable, including partial months. Free renders are provided specifically so you can evaluate the service before paying. If you no longer want the service, cancel and you will not be charged again.
You are shown this policy and asked to agree to it before any payment is taken. Purchased render packs are the one exception to expiry, not to refunds: they never expire, and they remain usable on your account even after a subscription is cancelled.
Your content and your rights
You keep ownership of the photographs you upload. By uploading, you grant us the limited licence needed to process the image, generate your render, and store both in your account.
You own the renders you generate and may use them commercially — in proposals, presentations, and marketing — provided you present them accurately as concept images and not as designs or guarantees.
You confirm that you have the right to upload each photograph you submit, including permission from the property owner where required.
Acceptable use
You agree not to:
- Upload images you do not have the right to use
- Upload unlawful, obscene, or infringing content
- Present a render as an engineering plan, survey, permit document, or binding quote
- Resell, sublicense, or provide access to the service to people outside your account
- Attempt to reverse engineer, scrape, or automate access to the service
- Use the service in a way that damages it or interferes with other users
We may suspend or close an account that breaks these rules.
Availability
We work to keep PoolCast AI running, but we do not promise uninterrupted service. The service depends on third-party providers, including Google's image model, and may be unavailable or slow because of their outages, maintenance, or capacity limits.
No warranty
The service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, or non-infringement. Generated images are approximations and may contain errors or details that could not be built as shown.
Limitation of liability
To the fullest extent allowed by law, Swimming in Sales LLC is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost sales, or lost business, arising from your use of the service. Our total liability for any claim is limited to the amount you paid us in the twelve months before the claim arose.
You are responsible for how you use renders in your own sales process, including any representation you make to a customer based on one.
Termination
You may stop using the service and close your account at any time. We may suspend or terminate access if these terms are broken, or if we discontinue the service. If we discontinue the service entirely, we will give reasonable notice by email.
Changes to these terms
We may update these terms. The date at the top of this page shows the latest version. Material changes will be communicated by email to account holders. Continuing to use the service after a change means you accept it.
Governing law
These terms are governed by the laws of the State of Florida, without regard to its conflict of law rules. Any dispute will be brought in the state or federal courts located in Duval County, Florida.
